On November 3, 2008 counsel for Volkswagen and the class attended the final approval hearing. One of the 29 class member objectors also attended the fairness hearing. The court deemed the objection of the attending class member "well taken" and stated that it was not going to "presently approve the settlement without prejudice."



As a result, the distribution of reimbursement monies to those class members who submitted claims cannot proceed at this time. Both Class Counsel and the attorneys for Volkswagen are working together to address the objector's concerns.

The following update was posted on the stellement's web site (http://www.timingbeltsettlement.com/) on February 9th:

"On December 15, 2008 the Court granted Final Approval of the Settlement. Claims are in the process of being reviewed and if your claim has been denied in whole or in part and/or if your claim was deemed incomplete, you will be notified in writing of your “Disputed Claim”.

Letters for “Disputed Claims” will begin mailing in February 2009.

Payments to qualified Class Members who do not have “Disputed Claims” will begin mailing by the end of February 2009.

I recieved my settlement check last night, and today it got deposited into my account. They awarded me the full amount I documented ($4,000+).
